Contractual and sales conditions for the assortment of products and goods
1. scope
The following General Terms and Conditions (hereinafter "GTC") govern the contractual relationship, including the initiation of business, between SYKK Handelsagentur (hereinafter SYKK Trading Agency) and a consumer or entrepreneur (hereinafter "customer/participant")* and apply to all orders and deliveries (online) of goods and products (hereinafter "goods") that are made using means of distance communication or direct sales, as well as registration and participation in seminars, courses, and lectures (hereinafter "events"), including offered consulting services.
Deviating or supplementary provisions in general terms and conditions of the customer/participant are not valid unless SYKK Handelsagentur expressly agrees to their validity in writing.
By placing a (binding) order for a product or registering for one of the above-mentioned events or other consulting or services offered, the customer/participant declares that he/she has taken note of the GTC and accepts them in full. In addition, the general notes attached to the respective participation/order confirmations shall apply.
1.1 Conclusion of contract
The descriptions of goods given on the homepage, in the business premises, and on the advertising materials of SYKK Handelsagentur do not constitute a binding offer, but merely a non-binding invitation to submit a binding offer on the part of the customer.
The customer can fill in an inquiry form in the online area and send it to SYKK Trade Agency.
After receiving the request, an employee will contact the customer by phone or e-mail. An automatic confirmation of receipt will be sent to the e-mail address provided. This automatic confirmation of receipt does not represent an acceptance of the order, but merely documents its receipt. The sales contract with SYKK Handelsagentur is only concluded when an order has been received and the corresponding amount has been credited to the account of SYKK Handelsagentur. After receipt of payment, the goods will be shipped to the customer or delivered personally. The order and the shipment of the goods will be confirmed to the customer by a separate e-mail (order / shipment confirmation).

1.2 Delivery and availability of goods
If the ordered goods are in stock, the customer's order will be processed immediately after receipt of payment and sent to the specified delivery address. If the goods are not immediately available, the customer will be informed immediately and will be given, as far as possible, the expected delivery date. If the customer does not agree with the expected delivery date or if the goods are not available, both parties are entitled to withdraw from the contract. The advance payment made will be refunded immediately in the event of withdrawal.
1.3 Right of withdrawal
If the customer is a consumer within the meaning of § 13 BGB, he has a statutory right of withdrawal without giving reasons in case of conclusion of a contract using the online form. The customer may exercise his right of withdrawal within 30 calendar days after the product has been delivered to him or to a third person indicated by him (other than the shipping company) or, if the customer has ordered several products with one order, which have been delivered separately, within 30 days after the delivery of the last product.
In order to exercise the right of withdrawal, the customer must inform SYKK Handelsagentur of his decision to withdraw from the contract by means of a clear declaration (e.g. a letter sent by mail, fax or e-mail). In order to comply with the cancellation period, it is sufficient that the customer sends the notification of the exercise of the right of cancellation before the end of the cancellation period.
The revocation is to be sent to the contact or address data given above.
1.4 Consequences of the revocation
In the event of an effective revocation, the services already received must be returned and any benefits derived (e.g. interest) must be surrendered. Payments already made by the
customer will be refunded immediately and at the latest within 30 days from the day on which SYKK Handelsagentur received the notification of revocation. The goods must be returned intact and in working order and must have arrived at SYYK.
If the performance received cannot be returned or can only be returned in part or only in a deteriorated condition, compensation for lost value shall be claimed in this respect. You do not have to pay compensation for any deterioration caused by the intended use of the goods. You will only have to pay compensation for the value of the goods if you have used the goods in a way that goes beyond the examination of the characteristics and functionality of the goods. By "testing the properties and functionality" we mean testing and trying out the respective goods, such as is possible and customary in a retail store.
The customer must return the goods to the above address immediately and at the latest within 30 days from the day on which he notifies SYKK Handelsagentur of the revocation of this contract. The deadline is met if the customer sends the goods before the expiration of the 30-day period. The customer bears the direct costs of returning the goods. He is also obliged to pack the returned goods appropriately. If the value of the goods exceeds 500.00 EUR, the package must be adequately insured, and the additional insurance costs incurred by SYKK Handelsagentur will be reimbursed. The customer has to enclose a letter with his address or the invoice copy including bank details to the package. After checking the goods, the purchase price will then be transferred to the bank account specified by the customer.
Right of return at SYKK Handelsagentur® ("Satisfaction guarantee")
If the customer is not satisfied with the goods, in this case the SYKK Family Immune Regulator®, he can return the goods to the SYKK trading agency within 30 days of delivery without giving reasons and without prejudice to his legal rights. The purchase price will then be refunded after receipt of the goods. In case of a return, the same applies as mentioned under point 1.4.
1.5 Prices and terms of payment
The prices indicated are always total prices. Any additional packaging and/or shipping costs will be indicated separately in the respective product description.
The packaging and/or shipping costs are specified in the purchase contract. Additional taxes or costs, such as customs duties or bank charges, which may be incurred especially in the case of shipment to non-EU countries, will not be paid through or invoiced by SYKK Handelsagentur, but are to be paid by the customer directly to the responsible customs or tax authorities. The customer must obtain details from the respective competent authorities.
1.6 Retention of title
Until full payment of the purchase price, the delivered goods remain the property of SYKK Handelsagentur.
1.7 Liability for defects (warranty)
Liability for defects shall be governed by the statutory provisions. The limitation period for statutory claims for defects is two years and begins with delivery of the goods.
Please note that the items shown (online) are often unique and the image may differ from the original. This is especially true for the color of the wood and the copper ring as handmade natural products.
2. liability
The liability of SYKK Handelsagentur is limited to the statutory provisions for damages to life, body, and health that are based on a negligent or intentional breach of duty by the same, its legal representatives, or vicarious agents, as well as for damages covered by liability under the Product Liability Act, and for damages based on intentional or grossly negligent breaches of contract, as well as fraudulent intent.
In case of culpable violation of essential contractual obligations, SYKK Handelsagentur is also liable in case of simple negligence, but limited to the damage typical for the contract and reasonably foreseeable at the time of conclusion of the contract. Essential contractual obligations are those whose violation endangers the purpose of the contract because the customer is thereby deprived of rights or such rights are limited that are to be granted to the customer according to the content and purpose of the contract.
Unless otherwise stated above, any further claims of the customer, irrespective of the legal grounds, are excluded.
Any liability of SYKK Handelsagentur for non-compliance with the application recommendation/recommendation for use is also excluded.
3. medical disclaimer
The content on the SYKK Handelsagentur website and promotional materials is intended for informational purposes only and should not be used as a substitute for medical treatment or self-diagnosis.
SYKK Handelsagentur is neither a doctor nor a non-medical practitioner, nor does it intend to replace them. It is therefore expressly pointed out that all events, consulting services, and goods of SYKK Handelsagentur are not intended to interrupt or discontinue ongoing medical treatment, or to postpone or completely omit any treatment that may become necessary in the future. SYKK Trade Agency does not cancel therapeutic orders under any circumstances. The responsibility lies entirely with the client.
SYKK Handelsagentur dissociates itself from healing statements and healing promises of any kind. A treatment of diseases or symptoms of diseases expressly does not take place.
4. data protection
SYKK Handelsagentur collects and uses the personal data provided (such as name, address, or e-mail address) in accordance with the provisions of applicable data protection law, in particular the EU General Data Protection Regulation (EU-DSGVO). You can find more detailed information on this in our data protection declaration under the heading "Data protection".
5. final provisions
The law of the Republic of Austria shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for any disputes is Stankt Veit an der Glan.
SYKK Handelsagentur is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
* Persons of male and female gender as well as diverse are always meant equally; for reasons of simpler readability, only the male form is used in the following.
